Family breakdown is inevitably a traumatic and difficult time. At Cocks Lloyd the experienced and specialist members of our Family Department aim to provide a comprehensive service on all aspects of marriage and relationship breakdown. We are committed to giving in depth advice on how to achieve the best outcome. We will explain the steps and options open to you, advise you how to proceed, negotiate on your behalf and if necessary take your case through the Courts.

FINANCIAL MATTERS

Settling financial arrangements arising out of relationship breakdown can potentially be lengthy, complex and expensive. We at Cocks Lloyd are committed to providing sensible realistic advice from the outset and, whilst committed to achieving the best outcome, will seek to resolve matters on your behalf in a timely, conciliatory and cost effective manner.

We offer specialist advice in the following areas:

  • Financial matters ancillary to divorce including maintenance, capital, transfer of property and pension provision.
  • Financial matters arising as a result of cohabitation breakdown including applications under the Trust of Land and Appointment of Trustee Act.
  • Schedule I Children Act Applications.

CHILDREN

We recognise that issues relating to children are important to you. We are able to advise on all aspects of law relating to a child’s upbringing. We have a thorough and comprehensive knowledge of all aspects of the Children Act 1989 and ensure that we adhere to the principle set out in Section 1 of the Children Act, which is that at all times the welfare of your children will be our paramount consideration.

We offer specialist advice in the following areas:

  • Child Arrangements Orders settling with whom the children are to live and how often they are to spend time with the other parent.
  • Child care – matters involving children where Children’s Services have intervened.
  • Adoption
  • Removing a child out of the UK to live (removal from jurisdiction).
  • Declaration of parentage.
  • Parental Responsibility.
  • Assisting wider family members e.g. Grandparents, in respect of both seeing and/or caring for children of the family.

Sometimes when there is a crisis in a family the Local Authority step in to protect the children. If this happens to you we can help. We have a great deal of experience in this type of work and provide sound sensible advice and assistance to try and avoid Court proceedings with a view to keeping your family together. We recognise how daunting it can be if Children’s Services become involved with your family and the importance of seeking advice as early as possible. Legal Aid is always available to any parent where the Local Authority applies to the Court for an Order that affects the parent’s legal rights in relation to their children. This can be an enormously stressful and disruptive time for you. Whatever your relationship to the children, we aim to provide a comprehensive range of representation and assistance, including clear and supportive advice at what we appreciate is an extremely difficult time for you and the children.

DOMESTIC ABUSE

At Cocks Lloyd we always take seriously allegations of abuse and violence in the home. In some circumstances we are able to offer Legal Aid to pursue domestic violence injunctions. We will discuss this with you in more detail if appropriate within an appointment.

We can assist with making application to the Court for the following orders:

  • Non-molestation injunctions
  • Occupation Orders
  • Protection from Harassment Orders.
