The Family Courts are finally catching up with the Criminal Courts.
From 21st July 2022, with the implementation of the Domestic Abuse Act 2021, victims of domestic abuse will be spared the trauma of being quizzed by abusers in Court where there is evidence of domestic abuse or in cases where there is a conviction or protective injunction between the parties.
In cases where this is relevant, and to ensure fairness for both sides, the Court will appoint a qualified legal representative to cross-examine the relevant witnesses if parties do not have their own legal representative and are unable to cross-examine due to being prohibited by the Court following allegations of domestic abuse.
